Document Description
The City of Agoura Hills last updated its Transportation Impact Fees (TIF) in 2011, which allows the City to collect an amount of money from a developer relative to the expected volume of traffic that the particular type and size of development is expected to generate. The City is updating its Transportation Impact Fees (TIF) to account for an increase in construction costs and expected future development, and to ensure that future developments pay their fair share for necessary improvements to the arterial street system. A “nexus” analysis was completed to demonstrate a reasonable relationship between the anticipated development, the need for new infrastructure, and the fees imposed. The 2025 Capital Improvement Program is a prioritizing and funding allocation program only, and does not have the potential to cause a significant impact on the environment.

Reasons for Exemption
The City Council has independently reviewed and considered the 2025 Nexus Report, the 2025 Capital Improvement Program, and the adoption of the proposed Transportation Impact Fees specified in this Resolution, and the proposed notice of exemption from the California Environmental Quality Act (“CEQA”) review prepared for the City’s 2025 Nexus Report, in accordance with the criteria contained in the CEQA and the State CEQA Guidelines. The City Council finds that approval of the 2025 Nexus Report, the 2025 Capital Improvement Program, and the adoption of the Transportation Impact Fees specified in this Resolution will not have a significant impact on the environment and are exempt from CEQA pursuant to Section 15061(b)(3) of State CEQA Guidelines because these actions involve the adoption of development impact fees and no specific development is authorized by the adoption 2025 Nexus Report, the 2025 Capital Improvement Program, and the adoption of the Transportation Impact Fees. Furthermore, the 2025 Capital Improvement Program is a prioritizing and funding allocation program and cannot and does not have the potential to cause a significant effect on the environment. No physical activity will occur until all required environmental reviews are conducted at the time the physical improvements prioritized in the 2025 Capital Improvement Program are undertaken at a future unspecified date. Therefore, the approval of the 2025 Nexus Report, the 2025 Capital Improvement Program, and the adoption of the Transportation Impact Fees specified in this Resolution does not have the potential for causing a significant effect on the environment. In addition, the adoption of this Resolution approves and sets forth a procedure for determining fees for the purpose of obtaining funds for capital projects and equipment necessary to maintain service within existing service areas and is statutorily exempt from CEQA pursuant to State CEQA Guidelines 15273(a)(4). Also, approval of the Capital Improvement Program associated with the Nexus Studies, is exempt from the requirements of CEQA pursuant to State CEQA Guidelines Section 15378(b)(4) because the 2025 Capital Improvement Program is not a “project” as defined by CEQA, but involves the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment.
