Reasons for Exemption
The Board has determined that the project activities within the Board's authority are exempt from CEQA pursuant to the Class 1 (Existing Facilities) categorical exemption (California Code of Regulations, title 14, section 15301). The project qualifies for this exemption because it is limited to the operation, repair, maintenance, permitting, or minor alteration of an existing facility and involves negligible or no expansion of existing or former use. Additionally, the project is exempt from CEQA under Class 3, (New Construction or Conversion of Small Structures) categorical exemption (California Code of Regulations, title 14, section 15303). The project qualifies for this exemption because it involves the construction or installation of small facilities or structures, or minor conversion of an existing small structure, consistent with this exemption. The Board further finds that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, title 14, section 15300.2 applies.
