Document Description
The project proposes to restore approximately 343 acres of perennial freshwater marsh habitat as part of the Snake Marsh Wetland Restoration Project through the construction of two earthen berms and installation of two 18-inch High-Density Polyethylene (HDPE) pipelines to convey irrigation water from an existing irrigation well to the marsh. The two pipelines, approximately 300 and 4,900 feet long, will be installed within 3.5-foot-deep trenches along existing access roads. The two berms will be approximately 1,750-foot and 750-foot long, 7-foot high, with 12-foot-wide crowns, 5:1 side slopes, and will include the installation of water control structures. The project also includes planting 35 native oak trees.

Reasons for Exemption
The Board has determined that the project is statutorily exempt from CEQA pursuant to Section 21080.56 of the PRC, which exempts a project to restore or provide habitat for California native fish and wildlife meeting certain requirements. On December 20, 2023, the CDFW Director concurred with the determination that the Project meets the qualifying criteria set forth in PRC Section 21080.56, subdivisions (a) to (d), inclusive. Specifically, the CDFW Director concurs that the Project meets all of the following conditions: (1) the Project is exclusively to conserve, restore, protect, or enhance, and assist in the recovery of California native fish and wildlife, and the habitat upon which they depend; or is exclusively to restore or provide habitat for California native fish and wildlife; (2) the Project may have public benefits incidental to the Project’s fundamental purpose; (3) the Project will result in long-term net benefits to climate resiliency, biodiversity, and sensitive species recovery; and includes procedures and ongoing management for the protection of the environment; and (4) Project construction activities are solely related to habitat restoration.
