Document Description
A three-year Extension of Time (EXT) 26-002 for Conditional Use Permit (CUP) 23-003 and Design Review Application (DRA) 23-004. CUP 23-003 and DRA 23-004 were originally approved on September 19, 2023 for the development of a 53,665 square foot warehouse and associated site improvements on an approximately 2.43 acre site. The original project was evaluated through an Initial Study/Mitigated Negative Declaration (IS/MND), adopted by the City’s Planning Commission together with a Mitigation Monitoring and Reporting Program (MMRP). A Notice of Determination was subsequently filed with the San Bernardino County Clerk on September 25, 2023.
EXT 26-002 does not authorize new development, modify the previously approved project, or result in a direct or reasonably foreseeable indirect physical change in the environment. Accordingly, EXT 26-002 is not considered a project subject to CEQA pursuant to CEQA Guidelines Sections 15060(c)(2), 15060(c)(3), 15378(b)(5), and 15378(c).
Additionally or in the alternative, if EXT 26-002 were considered a project under CEQA, the City has determined that there is no new information, no substantial changes to the project, and no substantial changes in the circumstances under which the project is being undertaken that would allow the City to perform additional environmental review of the project. (Pub. Res. Code § 21166 and CEQA Guidelines Section 15162.) Accordingly, no further environmental review is required.
