Document Description
A three-year Extension of Time (EXT) 26-003 for Conditional Use Permit (CUP) 22-011 and Design Review Application (DRA) 21-015. CUP 22-011 and DRA 21-015 were originally approved on May 16, 2023, for the development of a 47,899-square-foot warehouse and associated site improvements on an approximately 2.83-acre site. The original project was evaluated through an Initial Study/Mitigated Negative Declaration (IS/MND), adopted by the City’s Planning Commission together with a Mitigation Monitoring and Reporting Program (MMRP). A Notice of Determination was filed with the San Bernardino County Clerk and the State Clearinghouse on May 23, 2023.
EXT 26-003 does not authorize new development, modify the previously approved project, or result in a direct or reasonably foreseeable indirect physical change in the environment. Accordingly, EXT 26-003 is not considered a project subject to CEQA pursuant to CEQA Guidelines Sections 15060(c)(2), 15060(c)(3), 15378(b)(5), and 15378(c).
Additionally or in the alternative, if EXT 26-003 were considered a project under CEQA, the City has determined that there is no new information, no substantial changes to the project, and no substantial changes in the circumstances under which the project is being undertaken that would allow the City to perform additional environmental review of the project. (Pub. Res. Code § 21166 and CEQA Guidelines Section 15162.) Accordingly, no further environmental review is required.
