Categorical Exemption
Type, Section or Code
California Code of Regulations, title 14, sections 15301, 15302, 15303, 15311
Reasons for Exemption
The Board has determined that the project activities within the Board's authority are exempt from CEQA pursuant to the Class 1 (Existing Facilities) categorical exemption (California Code of Regulations, title 14, section 15301). The project qualifies for this exemption because it is limited to the operation, repair, maintenance, permitting, or minor alteration of an existing facility and involves negligible or no expansion of existing or former use. The project activities within the Board's authority are exempt from CEQA pursuant to the Class 2 (Replacement or Reconstruction) categorical exemption (California Code of Regulations, title 14, section 15302). The project qualifies for this exemption because it involves because the activity consists of replacement or reconstruction of two existing shelters, replacement of existing concrete paths and parking lots to comply with the Americans with Disabilities Act (ADA), picnic tables in the same location and will have substantially the same purpose and capacity as the replaced structure. Additionally, the project activities within the Board's authority are exempt from CEQA pursuant to the Class 3 (New Construction or Conversion of Small Structures) categorical exemption (California Code of Regulations, title 14, section 15303). The project qualifies for this exemption because it involves the construction of three small shelters and associated concrete pads; installation of one playground structure; benches, picnic tables, barbecue grills; and installation of electrical conduits in to serve the new and replaced structures. Finally, the project activities within the Board's authority are exempt from CEQA pursuant to the Class 11 (Accessory Structures) categorical exemption (California Code of Regulations, title 14, section 15311). The project qualifies for this exemption because it involves construction or replacement of minor structures accessory to existing facilities, at publicly owned parks or other facilities designed for public use. The Board further finds that none of the exceptions to the categorical exemptions set forth in California Code of Regulations, title 14, section 15300.2 apply.
