Document Description
The project activities involve the implementation of the Removal Action Workplan (RAW) for the 210 Baypointe Parkway project (project). Preparation of the RAW for the project site was triggered by the detection of elevated levels of chemicals of concern (COCs) in soil during sampling activities, including arsenic, hexavalent chromium, lead, cobalt, and nickel. The COCs are most likely attributable to historical agricultural use of the site. The remedial activities proposed in the RAW consist of limited removal of impacted shallow soil to 2 feet below ground surface in proposed softscape areas and capping with pervious pavers and clean import soil. Excavation associated with the remedial activities would require approximately 6,650 cubic yards of soil removal and 1,360 cubic yards of clean fill. The remainder of the onsite soil will be capped underneath the hardscape. The hardscape on the site (e.g., building foundations, roads, sidewalks) will serve as a cap. In addition, implementation of the RAW will record a land use covenant that will include limitations relating to excavation and management of soil in capped areas in order to minimize potential exposure to the underlying impacted soils. The City of San Jose, as Lead Agency, prepared the Baypointe Residential Development Environmental Impact Report (EIR) and was certified on October 15, 2024 (State Clearinghouse Number 2022120253). The site is proposed for redevelopment, including construction of residential apartments and townhome condominiums. As Responsible Agency under the California Environmental Quality Act (CEQA), DTSC conducted an independent analysis of potential environmental impacts associated with the remedial activities identified in the RAW. DTSC prepared an Addendum to the Final EIR for the Baypointe Residential Development project incorporating the environmental evaluation of the proposed RAW remediation to the City’s project.
