Document Description
The San Luis Obispo County Department of Public Works proposes to replace the South Bay Boulevard Bridge (Bridge No. 49C-0351), which spans Los Osos Creek (Project). South Bay Boulevard is one of the two main access routes in and out of Los Osos and the only direct connector between Los Osos and Morro Bay. The purpose of the project is to replace the existing bridge with a modern concrete bridge that meets current design and seismic standards to maintain safe, reliable service for the public. The project includes on-site pedestrian and bicycle enhancements, off-site public trail connections, and habitat restoration in compliance with the latest draft of the South Bay Boulevard Bridge Replacement Project Habitat Mitigation and Monitoring Plan (February 2024 or final approved document), including for the California Endangered
Species Act (CESA) candidate species, Morro manzanita (Arctostaphylos morroensis).
Candidate species are protected from take under CESA pursuant to California Fish and Game Code Section 2085. Fish and Game Code Section 2084 grants the California Fish and Game Commission (Commission) the authority to adopt regulations to authorize take of candidate species, based on the best available scientific information, when the take is otherwise consistent with CESA.
As a responsible agency, the Commission proposed a regulation (adding Section 749.14 to Title 14, CCR) pursuant to Fish and Game Code Section 2084 to authorize during CESA candidacy the take of Morro manzanita for the Project.
