Document Description
A request by Brad Fogel for a Minor Use Permit / Coastal Development Permit (C-DRC2025-00010) to allow for the construction of a new approximately 1,896 square foot, single-story, single-family residence with an approximately 495 square foot attached garage, entry porch, new driveway, and support appurtenances. The project will result in the disturbance of the entire approximately 0.07-acre vacant parcel. The proposed project is located within the Residential Single-Family land use category, accessed from Pasadena Drive (APN 038-733-012), within the community of Los Osos. The site is in the Estero Planning Area of the Coastal Zone.
BACKGROUND On July 27, 2010, the Board of Supervisors (Board) authorized the preparation of the Los Osos Habitat Conservation Plan (LOHCP). On December 15, 2020, the Board certified the Final Environmental Impact Reports for the Los Osos Community Plan (LOCP) (SCH #2015031090) and the LOHCP (SCH #2013091071) in accordance with the requirements of the California Environmental Quality Act (CEQA), including Public Resources Code Sections 21081 and 21082.1, and CEQA Guidelines Section 15090, which set forth the procedures and legal standards for preparation and certification of environmental impact reports. On February 15, 2024, the USFWS approved the LOHCP and issued the community-wide programmatic Incidental Take Permit (Permit No.: ESPER8245217) for a period of 25 years. As the permittee, the plan authorizes the County to issue Certificates of Inclusion that cover new disturbance via mitigation credit offsets and allowing for new development projects in Los Osos, as required by the Los Osos Community Plan (LOCP). On June 13, 2024, the California Coastal Commission certified Local Coastal Plan (LCP) Amendment Number LCP-3-SLO-21-0028-1-Part G. The Coastal Commission conditioned its certification by issuing a suggested modification to require that all development can only move forward with mandatory participation in the LOHCP and community-wide incidental taking permit approved by the U.S. Fish and Wildlife Service, or equivalent mitigation. Staff presented the LOHCP implementation packet to the Board on December 10, 2024, which included actions necessary for LOHCP implementation, in which the Board approved the requested funding and staffing.
