Document Description
Public Right of Way (PROW) Vacation to vacate a segment of 40th Street located west of the proposed development area, a segment of B Street located north of the development area, a segment of C Street located along the south side of the
development, and a segment of an alley located within the site; a Tentative Map (TM) to consolidate 16 existing lots into 10 new lots; and a Neighborhood Development Permit (NDP) to allow proposed dev1at1ons from the Land Development Code and Impacts to a site with environmentally sensitive lands (ESL). Deviations requested would allow modifications to the street frontage width, a reduction to the minimum distance from a curb cut to the side property line; an increase to the maximum
retaining wall height within a side yard setback; and a reduction to the minimum distance between an off-street parking space the back of a sidewalk. The development would Include 29 new, residential dwell mg units (11 single-family residences and 18 accessory dwelling units). The project also Includes the construction of a private drive to access the site and 1mplementatlon of a public
access easement over the private drive and street dedication to Improve the existing cul-de-sac at the western terminus of C Street. The project site Is located In the Southeastern San Diego Community Plan Area, the Airport Land Use Compat1b1hty Overlay Zone (San Diego International Airport (SDIA), Airport Influence Area (SDIA, Review Area 1), 60-65 dB Airport Noise Contours (CNEL), Affordable Housing Parking Demand (High), Very High Fire Hazard Seventy Zone and Brush
Management.

The project meets the requirements of CEQA Guidelines Section 15183, Projects Consistent with a Community Plan or Zoning. More spec1f1cally, the project would
construct 29 new, residential dwelling units (11 single-family residences and 18 accessory dwelling units) which Is consistent with the Residential - Low density {5-9 dwelling units/acre) community plan land use designation density established by the certified Southeastern San Diego Community Plan Update Program Environmental Impact Report (PEIR) and the underlying RM 3-1 zoning. In add1t1on, the project would not result in impacts that are (1) peculiar to the site, (2) not analyzed as
significant effects in the prior EIR, (3) cumulative or off-site Impacts not previously discussed in the prior PEIR, or (4) more severe than previously identified in prior PEIR. The site Is not included on any 11st complied pursuant to Government Code Section 65962.5 for hazardous waste sites. R-316527
