Document Description
Restoration of former salt-evaporation ponds to tidal wetlands and enhanced pond
habitats, improvement of flood protection levees, creation of upland transition ones adjacent to tidal wetlands and construction of public access trails, viewing platforms, and interpretive signs.
To provide public access and allow for future trail construction, operation, maintenance, repair, replacement, and removal of improvements and other trail amenities around Pond A2W, Valley Water would execute a Joint Use Agreement (JUA) with the United States Fish and Wildlife Service (USFWS) Don Edwards San Francisco Bay National Wildlife Refuge (Refuge). The JUA covers certain real property (premises) containing a portion of the east levee around Pond A2W, adjacent to the lowermost section of Stevens Creek before it flows into San Francisco Bay. The JUA would grant the Refuge license to access the premises and conduct activities associated with future trail construction operation, maintenance, repair, replacement, and removal. Upon future construction and opening of the trail, the Refuge would assume operational and maintenance responsibilities, including removal of trash, vegetation management, graffiti removal, and other activities described in the JUA. The JUA would remain effect for 25 years after its execution by both parties unless extended per the terms specified. Valley Water would have no role in the construction, operation, maintenance, repair, replacement, or removal of the trail and appurtenant facilities.
