Document Description
The Proposed Project was evaluated in the certified PWM/GWR. The PWM/GWR EIR project description included the Proposed Project to construct a new water diversion system to divert surface water from Lake El Estero to the City’s existing sanitary sewer system. Since the certification of the PWM/GWR EIR, engineering plans have been prepared for the Proposed Project which included minor modifications to the construction and operation of the Proposed Project. These modifications and engineering plans are evaluated in this Addendum. The Project would involve installation of a gravity intake system, including a 60-foot-long, 16-inch diameter discharge pipeline connecting to the sanitary sewer pipeline to divert the portion of untreated stormwater that currently flows from Lake El Estero into the Monterey Bay to the City’s sewer system to be treated at the Monterey One Water Regional Treatment Plant (“RTP”) and recycled for reuse. The Proposed Project would be constructed within existing paved and previously disturbed areas at the existing Lake El Estero Pump Station. The Proposed Project was fully evaluated in the certified PWM/GWR EIR. The physical boundaries have not changed nor have the minor modifications increased the severity of impacts compared to the project evaluated in the PWM/GWR EIR. Fee Requirements: Per California Code of Regulations 14, Section 753.5(e)(3), this Notice of Determination filing is not subject to the California Department of Fish and Wildlife (CDFW) environmental document fee. 14 CCR Section 253.5(e)(3) stipulates that only one fee is required when an exiting certified EIR is used for multiple project approvals that would result in no additional effect to fish and wildlife. This Notice of Determination for the project approval described herein does not require the CDFW fee because the approval relied upon the PWM/GWR Project EIR (State Clearinghouse No. 2013051094). The NOD for the PWM/GWR Project EIR was filed on October 8th, 2015, and the California Fish and Wildlife environmental document fee was paid at that time. See Attached the stamped Notice of Determination and the most recent receipt of fees paid.
