Document Description
The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under Division 4.5, California Code of Regulations, Title 22, Chapter 20 prepared an approval for a Hazardous Waste Facility Permit Renewal (Permit) pursuant to California Health and Safety Code, Chapter 6.5 for the Agritec International Ltd. dba CleanTech Environmental Incorporated Hazardous Waste Facility (Facility). The Facility currently collects used oil from offsite generators (gas stations, oil changers, auto repair shops, etc.) and consolidates the used oil in tanks at the Facility. The Permit Renewal will include the continuation of current operations for ten years, and the addition of an Oberg SB-600 filter crusher/bailer and SRS Designed Equipment ASU-1500 aerosol can shredder. There will be no construction for the proposed shredder and no physical modifications to the Facility other than the placement of the shredder as a result of this proposed change. The Facility does not operate a waste shredder under the current Permit. The addition of these items will not require any construction, ground disturbance, or significant changes to the current operations at the Facility. There will be no construction for the proposed crusher/bailer, or the aerosol can shredder, and other than the placement of the shredder, there will be no significant physical modifications to the Facility as a result of this proposed change. The proposed units will be installed in an existing building and will be anchored to the floor which will require no ground disturbance. The proposed aerosol can shredder unit will be permitted by the local air district. There are no other construction or additional changes to operations proposed in the permit application. The Facility is located at 5820 Martin Road in Irwindale, CA 91706 and currently operates under a Hazardous Waste Facility Permit. The applicant submitted their Facility permit application to DTSC on September 1, 2010. An Initial Study/Negative Declaration (IS/ND) was prepared in 2011. DTSC prepared a Response to Comments document, revised the IS/ND document, and reopened a subsequent public comment period. Following the final permit decision for the project and issuance of the Permit in December 2012 (State Clearinghouse Number: 2011111065), two petitions for review were received. The major issue identified in these two appeal documents was that the appellants believed that an Environmental Impact Report (EIR) should have been prepared for the Project. Additionally, Division 13, Chapter 4, Section 21150.1(a)(3) of the California Public Resources Code and Division 20, Chapter 6.5, Article 9.1, Section 25205.1(d) of the Health and Safety Code set a threshold of 1,000 tons per month as an EIR trigger for hazardous waste treatment facilities. Based upon these requirements and their potential legal interpretations, DTSC, along with the applicant and the two appellants, signed a Stipulation and Order document that vacated the permit and dismissed the two petition for review appeals, thus requiring DTSC to prepare an EIR for the proposed Project. A Supplemental EIR (SEIR) was prepared in 2014. A Notice of Determination for the SEIR (State Clearinghouse Number: 2011111065) was filed with State Clearinghouse on November 2, 2017, for a Permit authorizing the operation of the Facility for ten years.
