Reasons for Exemption
Reasons why project is exempt: The project consists of approval of a construction contract with Bay Cities for soil excavation and related activities necessary to implement the previously approved Downtown Workforce Housing Project (Resolution No. 2021-072), for which the City Council approved the related CEQA determination by Resolution No. 2021-071. The Downtown Workforce Housing Project is a residential project undertaken pursuant to and in conformity with the Downtown Specific Plan.
The excavation activities authorized by the contract are necessary to implement the previously approved Downtown Workforce Housing Project and were evaluated in the certified 2009 Downtown Specific Plan Subsequent EIR (SCH No. 2008092085) and incorporated into the adopted Mitigation, Monitoring and Reporting Program (MMRP). The City worked with the San Francisco Bay Area Regional Water Quality Control Board to implement site cleanup consistent with the MMRP, resulting in a Site Management Plan (SMP) approved by the Regional Water Quality Control Board. The SMP identifies excavation and offsite soil disposal associated with construction of the multifamily residential buildings and related site improvements. The construction contract therefore constitutes an implementing approval for the previously approved Downtown Workforce Housing Project and authorizes excavation activities previously contemplated and evaluated through the environmental review for the Downtown Specific Plan.
Accordingly, approval of the construction contract, as an implementing approval for the previously approved residential project, is exempt from CEQA pursuant to Government Code section 65457 and CEQA Guidelines section 15182(c). The proposed work is entirely within the scope of the Downtown Specific Plan EIR, dated February 9, 2004 (SCH No. 2003032038), the Downtown Specific Plan Subsequent EIR, dated March 30, 2009 (SCH No. 2008092085), and the Subsequent EIR Addenda adopted by the City Council on September 10, 2018, by Resolution No. 2018-153; May 13, 2019, by Resolution No. 2019-064; and October 26, 2020, by Resolution No. 2020-178. The environmental effects of the excavation activities authorized by the contract were previously evaluated in the certified 2009 Downtown Specific Plan Subsequent EIR and Addenda and are addressed through implementation of the adopted MMRP and the SMP. Therefore, the project is exempt from CEQA, and no further environmental review is required.
