The proposed project consists of an Extension of Time to allow for an additional three years (36 months) in which to utilize the previously approved Vesting Tentative Map, Site Development Permit, Neighborhood Development Permit, Public Right-of-Way Vacation, and Public Service Easement Vacation that would allow for the construction of 430 multi-family residential dwelling units including 52 affordable units, and approximately 6,000 square feet of commercial use. The 13.44-acre site is located at Otay Mesa Road within the Otay Mesa Community Plan area and is currently designated as Community Commercial - Residential Permitted and zoned CC-3-6, in addition, the site is located within Community Plan Implementation Overlay Zone Type A, Airport Compatibility Overlay Zone (Brown Field)/Airport Influence Area Review Area 2/FM Part 77 Noticing Area, Mobility Zone 4, and Very High Fire Hazard Severity Zone. (LEGAL DESCRIPTION: Lots 1, 2, 3, 4, 5, A and C of Handler Commercial, in the City of San Diego, County of San Diego, State of California). Assessor's Parcel Numbers: 645-410-0300 to 645-410-0900. Description of Previous Project: The City of San Diego previously prepared a Program Environmental Impact Report (EIR) No. 30330/304032; SCH No. 2004651076 for the Otay Mesa Community Plan Update.project. On March 11, 2014, the San Diego City Council (City Council) adopted Resolution No. R-308810, certifying the Environmental I mp act Report, and adopting Findings, Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program. The OM CPU Involved an update to the Otay Mesa Community Plan, a General Plan Amendment, rescission of the Otay Mesa Development District, adoption of a Rezone Ordinance to replace the Otay Mesa Development District with citywide zoning and creation of two new Community Plan Implementation Overlay Zones (CPIOZs), amendments to the City's Land Development Code (LDC), and an update of the Otay Mesa Community Plan Public Facilities Financing Plan (PFFP). The OMCPU provides for a long-range, comprehensive policy framework for growth and development in the Otay Mesa community. The BDM Mixed-Use project (Project No. 673818) was approved by San Diego City Council on June 6, 2023. The approved BDM Mixed-Use project included a Community Plan Amendment, Rezone, Tentative Map, Site Development Permit, Neighborhood Development Permit, Public Right-of-Way Vacation, and Public Service Easement Vacation to allow for the construction and operation of 430 multi-family dwelling units and 6,000 square feet of commercial use. The 13DM Mixed-Use project was previously reviewed in accordance with CEQA, and an Addendum to the OMCPU Final PEIR prepared and finalized on February 21, 2023. An Errata to this Addendum was prepared on April 7, 2023 to provide analysis clarifications. A Mitigation Monitoring and Reporting Program was adopted with the Addendum for the BDM mixed-use project.
