Document Description
The California Department of Toxic Substances Control (DTSC), pursuant to Division 4.5, California Code of Regulations, Title 22, Chapter 20, has prepared an Addendum to consider the approval of a Permit Variance application (Variance) pursuant to California Health and Safety Code section 25200 to the Hazardous Waste Facility Permit submitted by Ramos Environmental Services (Facility). The Variance is required due to the Facility’s request to continue truck to truck transfer of bulk liquid waste oil, waste antifreeze, oily water and oily sludge on and within a secondary containment loading/unloading pad at the hazardous waste storage and transfer facility located at 1515 South River Road, West Sacramento California, 95691. The California Health and Safety Code section 25201.6(i)(3)(A) requires any hazardous waste facility with an effective permit expiring on or after January 1, 2025, to submit a new application at least 2 years before the expiration date of the effective permit (defined as a timely application for the purposes of California Code of Regulations, title 22, section 66270.51) if the facility wishes to continue operating past the permit expiration date. The Facility did not submit their Permit Renewal Application 2 years before the expiration date of April 19, 2026. The Facility submitted their request for a Permit Renewal and DTSC is considering the Renewal separate from this Variance as there are further actions related to DTSC’s Permit Renewal process that have not been completed. The Variance would authorize the Facility to continue to operate while DTSC considers the Permit Renewal Application. The Variance will be effective for 1 year or until a final permit decision is made on their current permit application, whichever comes first.
Due to the expired Permit the Facility is not currently permitted to consolidate waste within the onsite above ground storage tank and the Facility is proposing to bulk the waste between small tanker trucks into a large tanker truck before transporting the waste to an authorized Transfer, Storage, and Disposal (TSDF) facility for proper recycling and disposal. The request is to continue to conduct this consolidation activity while DTSC is considering the Renewal. There are no proposed construction nor operational changes and no ground disturbing activities proposed by the Facility.
