The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under Division 4.5, California Code of Regulations, Title 22, Chapter 20 prepared an approval for a Post Closure Permit (Permit) Application pursuant to California Health and Safety Code section 25200 for ten years at the Clean Harbors Westmorland LLC Facility (Facility) located at 5295 South Garvey Road in Westmorland, CA 92281. The Permit is required to address necessary activities associated with post closure care at the Facility. The portions of the Facility under post closure care include three landfill cells: LC-1, LC-2, and LC-3. There are no anticipated operational changes, and no ground-disturbing activities proposed by Facility. This Addendum to the previously certified Environmental Impact Report (EIR) has been prepared to address activities associated with the new Permit. The Permit proposes two primary activities: 1) regular inspection and maintenance of the cap and cover; and 2) environmental monitoring, including run-on and run-off control systems and leachate collection and removal. The Clean Harbors Westmorland LLC Facility is located on South Garvey Road in Imperial County. In 2020, Clean Harbors LLC withdrew its Hazardous Waste Facility Permit renewal application and formally notified DTSC that it would cease all operations and begin final closure of the Facility. DTSC approved the termination of waste operations at the Facility on July 16, 2020. The only proposed project changes are to require regular post closure inspections of the final cover systems, security controls, vadose zone monitoring system, run-on and run-off control systems, and leachate collection and removal systems for landfill cell LC-2. Facility landfill cells LC-1 and LC-3 have been in post closure monitoring since 1991 and 1995, respectively. This project would not affect any aspect of the environment and requires no new construction. All additional activities will continue to be consistent with the Permit and will not result in physical changes. There are no proposed physical changes to the Facility that were not included in the previously approved Final EIR, which the prepared addendum is updating. The Permit would not result in new or substantially more severe significant impacts on the environment.
