Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
Exemption: §15301 Existing Facilities, §15305 Minor Alterations to Land Use Limitations
Reasons for Exemption
The City of San Diego determined that the project would qualify to be categorically exempt from CEQA pursuant to Section 15301, Existing Facilities, and Section 15305, Minor Alterations to Land Use Limitations. The project involves a Public Right of Way Vacation to vacate a small area within the PROW between 5895 Desert View Drive and 5915 Desert View Drive, and includes improvements to the existing street and sidewalk. Section 15301 applies to minor alteration of existing structures involving negligible or no expansion of existing or former use. The project includes improvements to the existing street and asphaltic berm, replacing the berm with a street curb, gutter, and sidewalk, to connect the existing sidewalk. The improvements are in an area of approximately 0.023 acres (1,002.32 square feet). Section 15305 allows for minor alterations in land use limitations in areas with an average slope of less than 20%, which does not result in any changes in land use or density. Examples include 15305 (a): Minor lot line adjustments, side yard, and set back variances not resulting in the creation of any new parcel. The project is on relatively flat land and would not result in any changes in land use or density and does not result in the creation of any new parcel. The site is not included on any list compiled pursuant to Government Code Section 65962.5 for hazardous waste sites. R-316927
