Notice of Exemption

Exempt Status
Categorical Exemption
Type, Section or Code
CEQA Guidelines Class3 Section 15303 New Construction or Conversion of Small Structures
Reasons for Exemption
Under CEQA, Class 3 Categorical Exemption consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. The activity is consistent with this exemption because the proposal will allow the installation of four (4) mainspring linear generators, 2000-amp bolt switch, switch rack and isolated transformer for electrical power generation, four (4) sea trains, security fencing and to expand the lot area by 17,400 sq. ft. of an existing biogas upgrading facility (private utility structure and transmission pipelines) on a 3.40-acre portion of a 438.65-acre parcel. Therefore, the use of CEQA Guidelines Class 3 Section 15303 New Construction or Conversion of Small Structures is applicable and appropriate.
