Reasons for Exemption
The project is exempt from the provisions of the California Environmental Quality Act as a ministerial project pursuant to Sonoma County Code Chapter 23A-8, Public Resources Code Section 21080(b)(1), and Cal. Code Regs. Tit. 14, 15268. The project involves removal of deteriorated components of an existing facility with no expansion of the existing use. No new development, replacement docks. fill, dredging, pile driving, vegetation removal, or increase in impervious surface is proposed. Affected developed surfaces and the public access trail will be repaired in kind. The project qualifies for a zoning permit, which the County, as lead agency, has designated as a ministerial process, and therefore, it is not subject to CEQA review.
