Notice of Exemption
Exempt Status
Categorical Exemption
Type, Section or Code
State CEQA Guidelines Categorical Exemption Section 15301 (Class 1. Existing Facilities).
Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The Project involves installation of two additional human-operated electric utility tractor rig (UTR) charging stations at TTI’s existing Pier T marine terminal. The two additional charging stations will be located in the same location as the previously approved electric UTR charging stations.
Exempt Status
Categorical Exemption
Type, Section or Code
State CEQA Guidelines Categorical Exemption Section 15303 (Class 3. New Construction or Conversion of Small Structures).
Reasons for Exemption
The Class 3 Categorical Exemption consists of construction and location of limited numbers of new, small facilities or structures, installation of small new equipment and facilities in small structures, and the conversion of existing small Port of
structures from one use or another, where only minor modifications are made in the exterior of the structure. Site work involves installation of above-ground rigid metal conduit and conductors, charger equipment mounted on steel support frames, local disconnects, and protective bollards.
Furthermore, the Port has determined that none of the exemptions to the exceptions set forth in State CEQA Guidelines Section 15300.2 foreclose the use of the categorical exemptions in Sections 15301 and 15303. Therefore, the project is exempt from CEQA and no further environmental review is required.
