Notice of Exemption
Exempt Status
Ministerial
Type, Section or Code
Sec. 21080(b)(1); 15268
Reasons for Exemption
The Board has determined that issuance of Permit No. 20050-1 is a ministerial action pursuant to Public Resources Code section 21080(b)(1) and California Code of Regulations, title 14, sections 15300.1, 15268, and 15369. The reissuance does not authorize a new project or any changes to the previously approved project activities. The action is limited to removal of a permit condition that was inadvertently included in the permit, and the Board has no discretionary authority to modify the project based on environmental considerations. Accordingly, issuance of Permit No. 20050-1 is exempt from CEQA, and the prior CEQA determination for Permit No. 20050 remains applicable.
